We provide credit assistance under the National Consumer Credit Protection Act 2009 (Cth). We help you understand, compare and apply for loans from the lenders available to us through our licensee. We do not lend money. Batth Finance does not make the credit decision; the lender does, after its own assessment. An enquiry is not an application or an approval. Business and commercial loans are generally not regulated by that Act, so some of the consumer protections described here may not apply to them [scope to be confirmed].
LMG Broker Services Pty Ltd authorises and supervises Batth Finance and, by law, is responsible to you for our conduct in providing credit assistance (National Consumer Credit Protection Act 2009, sections 64 and 75 to 78). You have the same remedies against the licensee as against us.
When we provide credit assistance for a home loan we must act in your best interests and give priority to your interests where there is a conflict (sections 158LE and 158LF). Before suggesting or helping you apply for any loan we must assess that it is not unsuitable for you. You can ask for a free copy of that preliminary assessment for up to 7 years.
Before we provide credit assistance we will give you our Credit Guide together with the LMG Broker Services Pty Ltd Credit Guide. A draft of our Credit Guide is published on this website for information; the guide is still given to you personally, by email with your consent or in person.
[To be confirmed whether we charge you any fee.] If we charge a fee we will give you a quote first and ask you to sign it. We may receive commission from lenders through our licensee, usually an upfront commission and an ongoing trail commission [commission ranges to be confirmed]. A reasonable estimate and the method of calculation are available on request and are shown in your proposal document. Any referral payments to third parties and any volume bonus arrangements are disclosed in our Credit Guide.
Our panel of lenders is accessed through our licensee. The six credit providers we do the most business with are listed in our Credit Guide [lender names to be confirmed].
Contact Batth Finance first. We acknowledge complaints within 1 business day and respond in writing within 30 calendar days. Complaints may be handled with our licensee's complaints team. We collect, use and disclose your personal information in accordance with our Privacy Policy, including disclosure to our licensee, lenders, mortgage insurers and valuers and, with your written authority, credit reporting bodies.
